Terms of Service

These Terms of Service (“Terms”) govern your access to and use of KittyBio, including our website, applications, services, features, and related content (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Description of the Service

The Service allows users to create accounts and enter, store, organize, and display information about their pets, which may include pet names, species, breeds, ages, photos, health notes, care routines, vaccination dates, behavioral notes, location-related information, and other pet-related content.

The Service is intended for informational, organizational, and personal-use purposes only unless we expressly state otherwise.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

You may not use the Service if you are prohibited from doing so under applicable law.

3. Accounts

To use certain features, you may need to create an account. You agree to provide accurate, current, and complete information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at [email protected] if you believe your account has been compromised.

We may suspend or terminate your account if we believe you have violated these Terms or used the Service in a way that may harm us, other users, animals, or third parties.

4. User Content

“User Content” means any information, text, images, photos, files, comments, pet profiles, pet records, or other materials you submit, upload, store, display, or otherwise provide through the Service.

You retain ownership of your User Content. However, by submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, transmit, and process your User Content as necessary to operate, maintain, improve, secure, and provide the Service.

You represent and warrant that:

  1. you have the right to submit your User Content;
  2. your User Content does not violate any law or third-party rights;
  3. your User Content is not false, misleading, defamatory, abusive, obscene, invasive of privacy, or otherwise harmful; and
  4. your User Content does not include information that you are not authorized to share.

5. Prohibited Uses

You agree not to:

  1. use the Service for unlawful, fraudulent, abusive, or harmful purposes;
  2. submit false, misleading, or deceptive information;
  3. upload content that infringes intellectual property, privacy, publicity, or other rights;
  4. upload malicious code, viruses, spyware, or other harmful software;
  5. attempt to gain unauthorized access to the Service or other users’ accounts;
  6. interfere with the security, availability, or proper operation of the Service;
  7. scrape, crawl, harvest, or extract data from the Service except as expressly permitted by us;
  8. use the Service to harass, threaten, abuse, or harm any person or animal;
  9. use the Service to facilitate animal cruelty, neglect, illegal breeding, illegal sales, or any other unlawful animal-related activity;
  10. impersonate another person or misrepresent your affiliation with any person or entity; or
  11. use the Service in violation of applicable laws or regulations.

6. Photos and Media

If you upload pet photos, videos, or other media, you are responsible for ensuring that you have the right to upload and share that content.

Do not upload content that reveals sensitive personal information, including addresses, license plates, financial information, medical records, or identifying information about children.

We may remove media that we believe violates these Terms, infringes third-party rights, creates safety concerns, or is otherwise inappropriate for the Service.

7. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

By using the Service, you acknowledge that we may collect and process information as described in the Privacy Policy.

You are responsible for deciding what information to enter into the Service. Do not submit information about another person unless you have the legal right or appropriate consent to do so.

8. Public and Private Information

Some features may allow you to make pet profiles or related information public, searchable, shareable, or visible to other users. Other features may be private or visible only to you or selected users.

You are responsible for reviewing your visibility and sharing settings. We are not responsible for consequences that result from information you choose to make public or share with others.

9. Third-Party Services and Links

The Service may include links to third-party websites, services, products, veterinarians, shelters, pet-care providers, advertisers, or other resources. We do not control and are not responsible for third-party content, practices, products, services, or policies.

Your use of third-party services is governed by the terms and policies of those third parties.

10. Fees and Payments

Certain features of the Service may be free, while others may require payment. If we offer paid features, the applicable prices, billing terms, renewal terms, and cancellation terms will be presented to you before purchase.

You agree to provide accurate payment information and authorize us or our payment processor to charge applicable fees. Except where required by law or expressly stated otherwise, payments are non-refundable.

11. Intellectual Property

The Service, including its software, design, text, graphics, logos, icons, trademarks, service marks, and other content, is owned by us or our licensors and is protected by intellectual property laws.

Except for your User Content and rights expressly granted to you, we reserve all rights in and to the Service. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service unless permitted by law or authorized by us in writing.

12. Feedback

If you provide feedback, suggestions, ideas, bug reports, or recommendations, you grant us the right to use them without restriction or compensation to you.

13. Service Availability

We may modify, suspend, or discontinue all or part of the Service at any time. We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at any particular time.

We may perform maintenance, updates, or changes that affect availability or functionality.

14. Data Backup and Loss

Although we may use reasonable measures to store and protect data, you are responsible for maintaining your own copies of important pet information, veterinary records, photos, and other content.

We are not responsible for loss, deletion, corruption, or failure to store User Content, except where prohibited by law.

15. Disclaimers

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.

We do not warrant that:

  1. the Service will meet your requirements;
  2. the Service will be uninterrupted, secure, or error-free;
  3. pet information stored in the Service will be accurate, complete, or current;
  4. any reminders, alerts, or notifications will be delivered on time or at all; or
  5. the Service will prevent harm, illness, injury, loss, or other adverse outcomes involving pets.

16. Limitation of Liability

To the fullest extent permitted by law, KittyBio, its owners, operators, employees, contractors, affiliates, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, or pet-related harm arising from or related to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of:

  1. the amount you paid us to use the Service in the 12 months before the claim arose; or
  2. $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless KittyBio, its owners, operators, employees, contractors, affiliates, and licensors from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  1. your use of the Service;
  2. your User Content;
  3. your violation of these Terms;
  4. your violation of any law or third-party right; or
  5. any pet-related activity, transaction, communication, or dispute involving you and another person or entity.

18. Termination

You may stop using the Service at any time. You may also request deletion of your account by contacting us at [email protected] or using account deletion tools we provide.

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, created risk for us or others, or used the Service improperly.

After termination, certain provisions of these Terms will continue to apply, including sections concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and any provisions that by their nature should survive.

19. Changes to the Terms

We may update these Terms from time to time. When we do, we will update the “Effective Date” above. If changes are material, we may provide additional notice, such as by email, account notice, or a notice on the Service.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.

20. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

21. Dispute Resolution

Before filing a claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally.

Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in San Francisco County, California, unless applicable law requires otherwise.
